Welcome to our Terms of Use! These Terms of Use explain the rules for using our website, our app and our newsletter. By accessing or using Aktivismo, or by creating an account, you agree to these Terms. If you do not agree, please do not use Aktivismo.
Who “we” are
When we say “we”, “us”, or “Aktivismo”, we mean the operator of these services: Johann Hubmann (sole trader). Our full legal details and contact information are available in the legal notice. “Aktivismo” is our project and brand name.
What these Terms apply to
These Terms apply to your use of the Aktivismo website (www.aktivismo.org), the Aktivismo app and web app (www.aktivismo.app) and our newsletter. They apply to all features made available through these services, including any future features we may introduce. If we launch additional community functions later, such as public profiles, posts, comments, forums, or chats, we may add or adapt rules for those functions and will update these Terms accordingly.
What Aktivismo currently offers
Our website provides information about Aktivismo and may include guides and other content intended to support civic and social engagement. Our app currently provides a campaign creation experience, including an AI-powered campaign generator, the ability to save campaign drafts and the ability to share campaigns via a link. We also offer an email newsletter if you choose to subscribe.
Minimum age
Aktivismo is intended only for people who are at least 16 years old. If you are under 16, you must not use Aktivismo and must not create an account.
Account registration and security
Some app features require an account. You must provide accurate information during registration and keep your login details confidential. You are responsible for activities performed through your account. If you suspect unauthorised access, please contact us as soon as possible so we can help secure your account.
Newsletter
If you subscribe to our newsletter, you consent to receiving emails from us. You can unsubscribe at any time, including via the unsubscribe link in emails or via your account settings where available. After you unsubscribe, we will stop sending newsletters.
Fair and lawful use
Aktivismo is designed to support constructive, lawful and respectful civic participation. You must not use Aktivismo in a way that violates applicable law, infringes the rights of others, undermines security, or disrupts the service. In particular, you must not attempt to access non-public areas without permission, interfere with or overload the infrastructure, use automated means to scrape or harvest content, distribute malware, conduct spam campaigns, or impersonate others. You must also not publish or share confidential information or personal data of third parties unless you have a clear legal basis and, where required, the person’s consent.
Code of Conduct
Our code of conduct forms a binding part of these Terms. It sets behavioural standards and content rules for using Aktivismo. If you breach these rules, we may take measures such as restricting features, limiting visibility of content, removing content, or suspending or terminating accounts, as far as permitted by law.
Your content and your responsibility
You are responsible for the content you create, upload, or share through Aktivismo, including campaign texts and any materials you include. You must ensure you have the necessary rights to use and share your content, and that it does not infringe copyrights, trademarks, personality rights, or other third-party rights. If you share a campaign via a link, you understand that anyone who receives the link may be able to view the campaign without logging in and may forward the link to others. Even if we do not actively enable search engine indexing, you should treat link-shared content as potentially widely accessible.
Licence you grant to us for operating Aktivismo
You keep ownership of the content you create, as far as the law allows. However, to operate Aktivismo, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit, display, and make your content available to the extent necessary to provide the service, including saving drafts, generating and displaying campaign content, enabling link sharing, ensuring security, preventing abuse and enforcing our rules. This licence also allows us to make your content available through technical service providers acting on our behalf, solely to the extent necessary to provide Aktivismo. If you delete content or delete your account, this licence ends for that content in principle, except where we must keep limited copies for legal obligations, security reasons, or to establish, exercise, or defend legal claims.
The AI campaign generator
The AI campaign generator is a tool to support your writing and brainstorming. It does not replace your own judgement or professional review. AI-generated outputs can be incomplete, inaccurate, misleading, or unsuitable for your purpose, and you are responsible for checking content before publishing or using it elsewhere, especially where it includes factual claims, quotations, legal topics, health-related topics, or other sensitive matters. You must not use the generator to produce unlawful content or to violate third-party rights. You should not enter sensitive personal data into the generator, such as ID details, private addresses, or health data, and you should not enter data about third parties unless you clearly have permission to do so.
Intellectual property and permitted use of Aktivismo
Aktivismo, including the website and app software, design, structure, brand identifiers, templates, texts created by us and underlying concepts, is protected by intellectual property laws. We grant you a limited, personal, non-transferable right to access and use Aktivismo for its intended purpose and in accordance with these Terms. You must not copy, reproduce, reverse engineer, decompile, scrape, or exploit Aktivismo or its content beyond what is necessary for normal use of the service, unless we expressly permit it or the law grants you a non-waivable right.
Feedback
If you provide suggestions, ideas, or feedback about Aktivismo, you allow us to use them without restriction and without compensation, unless mandatory law provides otherwise. We may incorporate feedback into the service, but we are not obliged to do so.
Availability, updates and changes to the service
We aim to provide a reliable service, but we cannot guarantee uninterrupted availability. Maintenance, security measures, technical faults and further development may lead to temporary restrictions. We may add, modify, or discontinue features to improve Aktivismo, to comply with legal requirements, or to keep the service secure and sustainable.
If you use Aktivismo as a consumer in Germany, mandatory statutory rules for digital services and digital content may apply. These statutory rights remain unaffected by these Terms. Where legally required, we will provide necessary updates to keep the digital service in conformity and secure.
Moderation and enforcement
We may review content and usage patterns to maintain security, prevent abuse and enforce our rules. If we believe that content or behaviour violates these Terms, the code of conduct, third-party rights, or legal requirements, we may take appropriate measures, including removing or restricting access to content, limiting functionality, or suspending or terminating accounts, as far as permitted by law. You do not have a right to have specific content published, displayed, or maintained permanently.
Termination by you and by us
You may stop using Aktivismo at any time. Where available in the app, you can delete your account. We may suspend or terminate access if you seriously or repeatedly violate these Terms, if misuse is suspected, if security requires it, or if we must do so for legal reasons. After termination, you may lose access to content stored in your account, subject to legal requirements and any applicable retention obligations.
Liability
We are liable without limitation where we act intentionally or with gross negligence, and for damages resulting from injury to life, body, or health. In cases of slight negligence, we are liable only if we breach a material contractual obligation whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely; in that case, liability is limited to the typically foreseeable damage. We do not assume responsibility for content created by users, to the extent permitted by law, and you use AI-generated and user-created content at your own risk. Nothing in these Terms limits mandatory statutory liability or mandatory consumer rights.
Changes to these Terms
We may update these Terms if we introduce new features, adapt to legal requirements, or make changes necessary for security and operation. If changes materially affect your rights or obligations, we will inform you in advance in a suitable way, for example via an in-app notice, on the website, or by email if we have your email address for account or newsletter purposes. The updated Terms apply from the stated effective date. If you do not agree with the updated Terms, you can stop using Aktivismo and delete your account before the effective date.
Data protection
We explain how we process personal data in our privacy policy. Please read it before using Aktivismo, especially before creating an account or subscribing to the newsletter.
App stores and third-party platforms
If you download the app via an app store, the store provider processes certain data under its own responsibility, for example for platform security and account management. Their terms and privacy information apply to those processes.
Governing law and place of jurisdiction
These Terms are governed by German law. If you are a consumer, mandatory consumer protection rules of the country in which you have your habitual residence remain unaffected. For merchants and legal entities under public law, the place of jurisdiction is, to the extent permissible, the registered place of business of the operator.
Consumer dispute resolution
We are not obliged and do not generally agree to participate in dispute resolution proceedings before a consumer arbitration board.
